Sadly, not in prison they aren't. Whether or not that should be the case I'll leave for another time.

Cases like this hinge on the level of review the court applies.  If the court ends up using rational review, then the regulation is almost certainly going to be upheld.  All the nonsense that takes place after the court decides on a level of a review is mental masturbation at best. 

In the end, I think the message the court is sending is "if you want to play an RPG, then don't smash in someone's skull with a sledgehammer."
